ARTICLE 1 : OBJECT
The general terms and conditions of sale govern the contractual relations between TENNISPRO and its customers. Any order validated by the consumer entails the latter's unconditional adherence to the general terms and conditions of sale. These conditions may be modified by TENNISPRO. In this case, the applicable conditions will be the ones in effect on the website at the time of the validation of the consumer's order.
These conditions will apply as of May 18th, 2011.
ARTICLE 2 : CONTRACTUAL INFORMATION
In accordance with the provisions of the Code of Consumption, the webstore implemented by TENNISPRO, within the context of the website, includes the following details :
- A legal disclaimer enabling precise identification of the company, TENNISPRO ;
- A presentation of the essential features of the items for sale ;
- An indication in Euros for all fees, including the price of the goods, services and delivery ;
- An indication of the payment, delivery and execution fees ;
- The offer and price validity ;
- The existence of a right of withdrawal.
All the information on www.tennispro.eu are displayed in English.
ARTICLE 3 : GOODS
a. The prices
The prices of our online products are indicated in Euro, all charges included, without the delivery charges. They are applicable during the validation of the order by the consumer (while stocks last).
It is important to note that if the articles have incoherent prices on the website, Tennispro (EX : one racquet for 1 Euro, one string reel for 4 Euros...), Tennispro is in the position to not deliver the order and the order will be cancelled or returned to Tennispro by the customer if there was a delivery by mistake.
Depending on the order's amount and the shipping destination, shipping charges may be added to the order's total. (see Delivery below).
Prices are subjected to French VAT. Any change of legal rate of this VAT will implicitly be echoed on the prices of products presented on the TENNISPRO website when stipulated by the application decree referring to it.
Articles will be sent free of taxes when shipped to a country off the European Union or in French Overseas Departments and Territories. However, customers will have to declare these articles upon reception.
The displayed public prices correspond to the suppliers' recommended retail price.
b. Availability
The offers presented by TENNISPRO are only valid while stocks last. In case of unavailability and according to the article L 121-20-3 of the Code of Consumption, you will be informed by mail or by phone about the articles out of stock.
The buyer will then have 72 manufactured hours (except Saturday, Sunday, public holidays and non-working days) to ask for cancellation, refund of the collected sums or the exchange of his/her order within the limits of an equivalent total price by contacting us by mail at [email protected].
After this period and if no request is made from you, your order will be sent to you with the available articles and only these latter will be charged.
Unavailable articles will be refunded using the same method of payment as the one used by the customer to settle his order.
The customer has the possibility of booking goods in order with our suppliers. In case of incomplete order, TENNISPRO reserves the right to send the goods when all the articles of the order are in stock. The client can ask TENNISPRO for an immediate delivery of the incomplete order. He will however be charged for the postal charges of the second sending.
c. Conformity of the offers of products
Proposed products are in accordance with the French current legislation and with the applicable standards in France.
According to the article L 111-1 of the Code of Consumption, the consumer has the possibility to know, before the definitive order taking, the essential characteristics of the product he wants to buy.
d. Discount codes and gift cards
Discount codes : you only have to insert the code in the area « discount voucher » to be found above your cart. The discount will then be immediately applied. Be careful, it is not possible to cumulate discount vouchers, which always have a period of validity.
Gift cards :
If you order a gift card on our website, we will e-mail you the gift card and indicate on the card the discount code that the addressed will be able to use in order to spend the received credit. You will receive the card by mail in a PDF format, so that you can print it and offer it to the person of your choice.
ARTICLE 4 : THE ORDER
a. Signing of the order
These Terms and Conditions of Sale come into effect in the date of signature of the order from our website www.tennispro.eu. According to the LEN law of June 24th, 2004, you have the possibility to check the details of the order and its total price (in Euro all charges included and products plus charges of delivery) and correct possible mistakes before confirming it in order to express its acceptance.
However, for personalised and customised items where the specifications have been ordered by the customer (Stringing on rackets / customization on rackets: matching, simple and/or complex customization / grip installation / overgrip installation / protection tape installation / handle size modification: cap installation, enlarger installation, size-up installation / printing / embroidery / …) we will be unable to make any changes or modifications once the order has entered the preparation stage in store or at the warehouse.
TENNISPRO will immediatly acknowledge receipt of your order by electronic means.
b. Transfer of property
TENNISPRO keeps the full property of sold products until perfect cashing of all the amounts due by the consumer in the framework of his/her order, charges and taxes included.
The transfer of property of a good bought on www.tennispro.eu by the consumer to an other person will not be the responsability of TENNISPRO. Only the original buyer of this good can claim to reach the clauses of the present Terms and Conditions of Sale.
c. Proof of the transaction
The archiving of order forms and invoices will be made on a reliable and long-lasting support which can legally be produced as proof.
ARTICLE 5 : WITHDRAWAL AND GUARANTEES
In accordance with current legislation, our products benefit from the legal right of withdrawal, which we have extended to a period of 30 days from receipt of the order. More information on this page
A two-year legal guarantee of conformity applies to your purchases, including tennis rackets. If a racket is defective other than through normal use, the customer can return it to Tennispro Distribution. It will undergo a thorough analysis by us to determine whether it has a defect and will then be returned to the supplier if necessary. According to articles 211-1 to 211-4 of the Consumer Code: Before March 18, 2016, the presumption of prior existence is 6 months from the date of delivery for all goods. The consumer is not required to provide proof. For goods purchased after March 18, 2016, all conformity defects appearing within 2 years of purchase, except for second-hand goods for which the period remains 6 months, are presumed to exist. The consumer will not have to provide additional proof as it is up to the professional to prove that the defect did not exist. You will then be contacted as soon as possible by Tennispro Distribution's after-sales service. If the claim is accepted, the customer may obtain an exchange or repair from Tennispro Distribution, depending on the product. If the repair or replacement of the product cannot be carried out or is not desired by the customer, a voucher equivalent to the purchase price of the item will be offered. When the responsibility of Tennispro Distribution or one of its suppliers is engaged, the return costs are covered by providing a prepaid return label. Credits issued for a return/cancellation are valid for one year and will be automatically settled after this period.
Pre-contractual information on legal guarantees
The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer only needs to establish the existence of the lack of conformity and not the date of its appearance. When the sales contract for the goods provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to this digital content or digital service throughout the entire supply period. During this period, the consumer only needs to establish the existence of the lack of conformity affecting the digital content or digital service and not the date of its appearance. The legal guarantee of conformity obliges the professional, if necessary, to provide all updates necessary to maintain the conformity of the goods. The legal guarantee of conformity gives the consumer the right to repair or replace the goods within thirty days of their request, free of charge and without major inconvenience to them. If the goods are repaired under the legal guarantee of conformity, the consumer benefits from an extension of six months of the initial guarantee. If the consumer requests the repair of the goods, but the seller imposes the replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods. The consumer can obtain a price reduction by keeping the goods or terminate the contract and receive a full refund against the return of the goods if:
The professional refuses to repair or replace the goods; The repair or replacement of the goods occurs after a period of thirty days; The repair or replacement of the goods causes major inconvenience to the consumer, especially when the consumer permanently bears the costs of returning or removing the non-conforming goods, or if they bear the installation costs of the repaired or replaced goods. The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity. The consumer also has the right to a price reduction or termination of the contract when the lack of conformity is so severe that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request the repair or replacement of the goods beforehand.
The consumer does not have the right to terminate the sale if the lack of conformity is minor. Any period of immobilization of the goods for repair or replacement suspends the guarantee that was still running until the delivery of the repaired goods. The above-mentioned rights result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code. The seller who obstructs the implementation of the legal guarantee of conformity in bad faith risks a civil fine of up to 300,000 euros, which can be increased to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code). The consumer also benefits from the legal guarantee against hidden defects in accordance with Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept or a full refund against the return of the goods.
ARTICLE 6 : DELIVERY
TENNISPRO delivers its products to countries within the European Union and to countries outside the EU. Products will be sent at the address indicated by the customer on the order form.
When your Tennispro order is tax free, the consumer might have to pay VAT and custom fees to the carrier during delivery
Non-EU countries : Due to the specificity of the procedure, any customer wishing to have its parcel shipped to a non-EU country should call this number : +44 (0)2036 081 983.
Any order placed before 12pm will be shipped the same day regardless of the shipping method (excluding Saturday, Sunday and public holidays). Orders placed after 12pm will be shipped within 24 hours by the transporter chosen by the customer at the time of the order (excluding Friday, Saturday, Sunday and holidays).
For heavy articles (nets, court accessories, boards of reservation, ball cases, …) a variable supplement is asked depending on the country of delivery without franco (see table below).
Prices for postal charges for heavy articles do not apply to stringing machines.
The consumer has the legal and contractual obligation to verify the physical state and the contents of the parcel in the delivery in the presence of the deliverer.

Due to Brexit, Tennispro is no longer able to ship to the UK.
All returns from countries outside of the EU will be reimbursed. There will be no exchange possible.
a. Anomaly
Any anomaly regarding the delivery must be indicated on the delivery note of the deliverer, in the form of « handwritten reserves » detailed, dated, explicit and accompanied with the signature of the consumer or the one of a person authorized to receive the delivery.
At the same time, the consumer will have to signify this anomaly by addressing to the deliverer in the 3 business days following the delivery date a registered letter with acknowledgement of receipt exposing the aforementioned complaints.

Any complaint regarding the delivery received after the deadline will be rejected without any possibility of appeal for the consumer and only the damages and anomalies mentioned in the reserves uttered by the consumer will be taken into account in the resolution of the dispute by the carrier.
b. Delay in the delivery or non-fulfilment of the order
TENNISPRO can not be held responsible for the non-fulfilment of the contract in case of stock shortage or unavailability of the product, force majeure, disturbance, all-out or partial strike in particular from postal services and means of transportation and/or communication, flood and fire.
TENNISPRO incurs no responsibility for any indirect damage because of operating losses, losses of profit, losses of luck, damage or expenses that could arise because of the purchase of products.
c. Return to the warehouse :
Due to circumstances beyond our control and the uncertainties of the transportation world, it may happen in rare cases that your package is unfortunately redirected to our warehouse. If this occurs, don't worry! Upon receipt of the package, we will refund the full amount of your order so that you can quickly place a new order on our website.
ARTICLE 7 : PAYMENT
The whole payment must be made at the time of the order (except for the repayment delivery method). The collected sums can never be considered as deposit or advances. The consumer guarantees TENNISPRO that he has the necessary authorizations to use the payment method that he chose during the validation of his order. Furthermore, TENNISPRO reserves the right to suspend any management of order or any delivery should the authorization be refused by the financial organisms.
a. Payment methods
The consumer will have various methods of payment at his disposal to pay his order during the finale validation of the order form. Tennispro reserves the right to ask the consumer for a scan of his ID card, a proof of address and any necessary document within the framework of its anti cheats policy.
Non-EU Countries : Non-EU customers will have to pay by bank transfer. Given the specificity of the procedure and the fees generated by the shipping, non-EU customers cannot pay neither by credit card nor Paypal.
Payment by credit card
The treatment of payment by bank card on our website is entirely secured.
With this payment facility, you will be sold at the time of the payment of your order.
TENNISPRO uses the Crédit Mutuel's banking transactions platform.
Your data are thus coded by the SSL process, guaranteeing a maximal safety.
Your bank card number is neither stocked on the server nor printed.
The order validated by the consumer on the internet website will be effective only upon approval of the bank cards central network. Should the latter refuses, TENNISPRO reserves the right to cancel the order and stop the shipment of the goods. In this case, the consumer will be contacted by mail of by phone as soon as possible.
Secure payment by PayPal
If you have an account on the PayPal online payment platform, you can also use it to pay for your purchases on our site. This online method is easy to use and allows for fast processing. The identity of the PayPal account is defined by the customer's e-mail address. A payment made via this platform will be credited immediately unlike a bank transfer which involves a longer verification time.
Payment by wire transfer
In case of wire transfer, the goods will be reserved for you for 8 days from the moment your order was passed on our website. After this deadline, the goods will be placed back in the stock.
Your order will be sent only upon receipt of your payment.
As well as the deadline of shipping, the deadline of availability is to be recalculated from the date the payment method was registered.
The bank account identification will be communicated when you are ordering.
Other means of payment / foreign currencies
Any other mean of payment and/or foreign currency will have to be agreed upon and will generate a 15€ additionnal cost, which will be at the customer's expense.
b. Irrevocability of the payment
According to the article L 132-2 of the Monetary Code, electronic payment is irrevocable. Thus, TENNISPRO recommends its consumers to make sure of the solvency of their payment before validation of their order on the website.
ARTICLE 8 : NEWSLETTER
Every subscriber to the electronic letter of information agrees to receive e-mails of information on the TENNISPRO offers.
In order to be removed from the mailing list, the subscriber must send an e-mail to [email protected] or unsuscribe in the column « my account » on the website at the address www.tennispro.eu.
